ADULTERY

Today, adultery is punished by payment of cash fines (to local courts) and compensation, usually also in cash. These compensatory payments go to the girl’s father if she is unmarried and to her husband if she is. If a husband accepts such a payment, he cannot then use adultery as grounds for divorce of the wife and he must accept any subsequent children as his own.

A man pays (kuhalalisha), usually in cash, in addition to his adultery fine if he desires jural rights in any child pronounced out of wedlock. If no such payment is made or if it is refused by the girl’s kin, such rights in the child are held by her maternal and paternal kin. Disputes arise mainly over daughters rather than sons where rights in future bridewealth would be at issue. In general, the bulk of such subsequent rights in a person may rest with either the maternal or paternal kin of the girl, depending upon where she resides and which group had provided the most food and other benefits for the mother and growing child. Although it is clear that in the past all such rights were probably held by matrilineal kin, no such generalization may be made today.
